Mr. Md. Mydul Haque Khan, one of the two Partners of the firm and a former associate of Lee, Khan & Partners, has gained versatile knowledge in handling large scale local and multi-national syndicated lending facilities, structured finance, on-shore and offshore project finance, and other financial structures prevailing in the banking and financial sector during his tenure in Lee, Khan & Partners, the most prominent and the largest law chamber of the country in the corporate arena under the guidance of top corporate lawyers namely Mr. M. Moniruzzaman Khan, Barrister-at-Law and Ms. Lee Mei Yoke (Marium Khan) Barrister-at-Law.
Mr. Khan has experience in working in close collaboration of foreign law firms (notably, Clifford Chance, Allen & Overy, Baker & Mckenzy, Ashurst) in connection with various off-shore financing project, large scale syndicated loan for setting up power projects, garments, spinning and knitting industries, telecommunication business, coupon bearing bond issuance, zero coupon bonds, financing new and up-coming industries in Bangladesh. Some of the notable projects undertaken by Mr. Khan includes: (a) acted as a legal counsel for IFC in granting of term loan facility of BDT 1,500,000,000.00 by Citi Bank N.A. against the standby loan and guarantee of IFC for the expansion of the BRAC's Micro Credit Finance Program and small and medium enterprises lending portfolios, (b) acted as the legal counsel of the Eastern Bank Limited as trustee against coupon-bearing bond issuance of Grameenphone Ltd. of BDT4,250,000,000.000, (c) structuring and finalising syndicated finance for the power project namely Regent Power Limited arranged by Eastern Bank Limited under the Govt. funding scheme of Investment Promotion and Financing Facility Project (IPFF), (d) recovery of offshore loan granted by DEG-Deutsche Investitions-Und Entwicklungsgesellschaft Mbh (DEG) to the tune of EUR 3,500,000.00 to Hamid Fabrics Limited, (e) structuring, drafting and finalising the syndicated term loan facility for the Broadband Wireless Access (WIMAX) project of Banglalion Communications Limited to provide wireless internet service with IP telephony all over the country arranged by AB Bank Limited to the tune of Tk. 2042.00 million, (e) acted as the on-shore legal counsel of DEG-Deutsche Investitions-Und Entwicklungsgesellschaft Mbh (DEG) in sanctioning US$ Term Finance amounting to US$ 20 million to Eastern Bank Limited, (f) structuring, drafting, collaborating with foreign law firm namely Allen & Overy and finalising the largest syndicated financing in Bangladesh of Tk. 5,908 million and US$40 million granted to BSRM Steel Mills Limited with participation of 25 national and international banks that has been jointly arranged by IDLC Finance Limited, The City Bank Limited and Standard Chartered Bank for setting up steel melting and billet casting plant in Mirsarai, Chittagong, (g) advising, drafting and finalising the first ever issue of Commercial Paper in Bangladesh by Advanced Chemical Industries Limited under the arrangement of Eastern Bank Limited. Mr. Khan has been the pioneer lawyer involved in this brand new mode of financing in Bangladesh introduced by the most diversified bank in the arena of structured finance in Bangladesh namely Eastern Bank Limited.
In furtherance to his specialized skills in banking and financial matters, Mr. Khan has wider knowledge and skills in drafting, vetting and providing various opinions in relation to foreign investments, share acquisitions & takeovers, mergers, joint-ventures, company formation, Society and NGO formations and regulations, consultancy in relation to various business formations along with required structuring, employment and issues regarding labour disputes, real estate and land issues.
